Terms of Service

1. Agreement to Terms

By accessing or using The Daily Dev mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these Terms, you may not access or use the App.

2. Description of Service

The Daily Dev is a mobile application that provides daily system design questions and challenges to help developers enhance their knowledge. The App offers:

  • Daily system design questions
  • Multiple question types (multiple choice, matching, ordering)
  • Progress tracking and statistics
  • Subscription-based access to premium content

3. User Accounts

Account Creation

  • You must create an account to use the App
  • You may sign up using email/password, Google, or GitHub
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate and complete information when creating an account

Account Responsibilities

  • You are responsible for all activities that occur under your account
  • You must notify Arjay McCandless LLC immediately of any unauthorized use of your account
  • You must be at least 13 years old to use the App
  • One person or entity may not maintain more than one account

4. Subscription Terms

Free Trial

  • New users may be eligible for a free trial period
  • Trial terms will be clearly displayed before you begin
  • You will be charged automatically after the trial period ends unless you cancel

Subscription Plans

  • Arjay McCandless LLC offers monthly and annual subscription plans
  • Subscription fees are charged in advance
  • Prices are subject to change with notice

Auto-Renewal

  • Subscriptions automatically renew unless cancelled
  • You will be charged at the beginning of each billing period
  • You can cancel your subscription at any time through the App or billing portal

Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You will continue to have access until the end of the paid period
  • No refunds are provided for partial billing periods

Refunds

  • Refunds are handled in accordance with Apple's App Store refund policy
  • Arjay McCandless LLC does not provide direct refunds - all refunds must be processed through Apple
  • Refund requests should be submitted through Apple Support

5. User Content and Conduct

Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's operation
  • Reverse engineer, decompile, or disassemble the App
  • Share your account credentials with others
  • Use automated systems to access the App

User Feedback

  • You may submit feedback through the App
  • By submitting feedback, you grant Arjay McCandless LLC the right to use, modify, and incorporate your feedback without compensation

6. Intellectual Property

Company Content

  • All content in the App, including questions, explanations, and design, is owned by Arjay McCandless LLC
  • You may not copy, reproduce, distribute, or create derivative works from Arjay McCandless LLC's content
  • The App and its content are protected by copyright, trademark, and other intellectual property laws

Your Rights

  • You retain ownership of any content you submit
  • You grant Arjay McCandless LLC a license to use your content as necessary to provide the service

7. Disclaimers and Limitations of Liability

Service Availability

  • Arjay McCandless LLC strives to provide reliable service but does not guarantee uninterrupted access
  • The App may be unavailable due to maintenance, updates, or technical issues
  • Arjay McCandless LLC is not liable for any loss or damage resulting from service unavailability

Content Accuracy

  • While Arjay McCandless LLC strives for accuracy, the Company does not guarantee that all content is error-free
  • Questions and explanations are provided for educational purposes
  • You use the content at your own risk

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ARJAY MCCANDLESS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ARJAY MCCANDLESS LLC'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE CLAIM
  • ARJAY MCCANDLESS LLC PROVIDES THE APP "AS IS" WITHOUT WARRANTIES OF ANY KIND

8. Termination

By You

  • You may stop using the App at any time
  • You may delete your account through the App settings
  • Cancelling your subscription does not automatically delete your account

By Arjay McCandless LLC

Arjay McCandless LLC may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Arjay McCandless LLC discontinues the service
  • For any other reason at Arjay McCandless LLC's sole discretion

Effect of Termination

  • Upon termination, your right to use the App ceases immediately
  • Arjay McCandless LLC may delete your account and data
  • Provisions that by their nature should survive will remain in effect

9. Changes to Terms

  • Arjay McCandless LLC reserves the right to modify these Terms at any time
  • Arjay McCandless LLC will notify you of material changes via the App or email
  • Continued use of the App after changes constitutes acceptance
  • If you disagree with changes, you must stop using the App

10. Dispute Resolution

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Dispute Resolution Process

  • First, contact Arjay McCandless LLC at thedailydev@arjaythedev.com to attempt to resolve the dispute
  • If Arjay McCandless LLC cannot resolve the dispute, both parties agree to binding arbitration
  • You waive your right to a jury trial and class action lawsuits

11. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

  • These Terms are between you and Arjay McCandless LLC, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support for the App
  • If the App fails to conform to any warranty, you may notify Apple for a refund
  • Apple is a third-party beneficiary of these Terms

12. General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Arjay McCandless LLC regarding the App.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

Assignment

You may not assign these Terms without Arjay McCandless LLC’s consent. Arjay McCandless LLC may assign these Terms at any time.

Waiver

Arjay McCandless LLC’s failure to enforce any provision does not constitute a waiver of that provision.
